CATEGORICAL EXCLUSION

TO ALL INTERESTED AGENCIES AND PUBLIC GROUPS:

 

As provided by the state environmental review process adopted in the Permanent Rules of the Texas Water Development Board (Board) 31 Texas Administrative Code §371, subchapter E, for projects to be funded through the Drinking Water State Revolving Fund (DWSRF) Program and consistent with the National Environmental Policy Act, 42 U.S. Code §4321, et seq., the Executive Administrator of the Board has determined that the proposed action identified below may be exempted from formal environmental review requirements:

City of Wortham, Freestone County, Texas

Water Line & Meter Replacement Project

DWSRF Project No. 62524

Total Estimated Project Cost: $1,843,129

The City of Wortham (City) is proposing to use funding from a $1,843,129 DWSRF loan to: (1) perform a leak detection study; (2) replace approximately 18,500 linear feet (LF) of 1-inch to 8-inch diameter water line with 4-inch to 8-inch water lines at various locations within existing rights-of-ways (ROW) and easements; and, (3) replace all water meters within the City and implement an automated meter reading system (maps available upon request).  In addition, the project may require adequate isolation valves, fire hydrants, fittings and all necessary appurtenances, including pavement repairs.  This loan will fund the planning, design and construction phases of this project. 

Existing lines will be replaced by new lines in the same or proximate locations.  The existing lines will either be removed or abandoned in place.  Environmental impacts should be similar to rehabilitation activities and limited to those associated with excavation, pipe installation, and road repair.  Although in some cases, the depth of excavation may be greater than the existing pipe and the location of the replacement pipe may not be immediately adjacent to the existing line (e.g., opposite side of street), a Board staff archaeologist has reviewed the proposed project and determined that the project is not likely to affect any significant or potentially significant cultural resources.  In addition, construction within existing rights-of-ways and easements is not expected to impact threatened or endangered species or habitat.  The project will not adversely impact wetlands or waters of the U.S. that are under the jurisdiction of the U.S. Army Corps of Engineers (USACE).  Although some drainage areas within the City that might be crossed may be considered waters of the U.S., all project work should be authorized under Nationwide Permit 12 (Utility Line Activities) without requiring a preconstruction notification of the USACE.  Portions of the proposed pipeline replacements are in the 100 year floodplain and will require crossing a creek.  For these segments the City will be using trenchless construction methods for pipe replacement as an avoidance measure. 

This decision is allowed because the specified project elements should not entail significant adverse impacts to the quality of the human environment.  Documentation supporting this determination is on file at the TWDB. 

The exclusion will be revoked if (1) it is found that, due to changes in the project, the proposed action no longer meets the criteria for an exclusion, (2) evidence is found that the project may have serious environmental effects, or (3) it is found that Federal, State, or local laws are being or may be violated by implementation of the project.  The project activities must comply with the following conditions:

  • Standard emergency conditions for the discovery of threatened and endangered species; and,
  • Standard emergency conditions for the discovery of cultural resources.
